This article introduces and discusses a short correspondence that took place in November 1931 between Gershom Scholem and Jacob Gordin. Gordin was a Russian-Jewish philosopher of religion, an expert on Hermann Cohen, and a founding figure of the postwar Paris School of Jewish Thought. The initial motivation for the correspondence was Scholem’s wish to produce a critical edition of the 17th century kabbalistic work, Shaar Hashamayim by Abraham Cohen Herrera, for which he asked for Gordin’s help. A close reading (...) of Gordin’s response to Scholem and Scholem’s belated response to Gordin highlight the respective views of these thinkers regarding the relationship between kabbalah and Western philosophy in the modern era, and in German idealism in particular. The development and use of advanced and innovative neuroscience, neurotechnology and some forms of artificial intelligence have exposed potential threats to the human condition, including human rights. As a result, reconceptualizing or creating human rights (i.e. neurorights) has been proposed to address specific brain and mind issues like free will, personal identity and cognitive liberty. However, perceptions, interpretations and meanings of these issues—and of neurorights—may vary between countries, contexts and cultures, all relevant for an international-consensus definition and implementation of neurorights. (...) Thus, we encourage reflecting on the proactive inclusion of transnational, cross-cultural and contextual considerations and concerns to contribute to the global discourse. This inclusion does not mean endorsing ethical relativism but rather a call to foster a universal understanding of key concepts and concerns. Including contextual and cultural perspectives may truly anticipate global concerns which could be addressed while developing and implementing neurorights. Consequently, any ethical and/or legal regulatory framework(s) for the translational and transnational use of advanced neuroscience, neurotechnology and some forms of artificial intelligence intended to protect and safeguard human dignity should be contextually and culturally mindful, responsible, respectful and inclusive of not only human rights and fundamental freedoms but also of neurocognitive cultural diversity. Open Letter to Comrade Žižek is an attempt to question and highlight some incongruous points that Slavoj Žižek, one of the greatest critics of capitalism and its ideological effects in the contemporary world, expressed in his latest books about the Pandemics. The text focuses in the economic, political, social and cultural consequences of Žižek’s position and goes further in developing another position related to the spread of COVID-19 and the preventive measures to fight it.

A long tradition of research including classical rhetoric, esthetics and poetics theory, formalism and structuralism, as well as current perspectives in (neuro)cognitive poetics has investigated structural and functional aspects of literature reception. Despite a wealth of literature published in specialized journals like Poetics, however, still little is known about how the brain processes and creates literary and poetic texts. Still, such stimulus material might be suited better than other genres for demonstrating the complexities with which our brain constructs the world (...) in and around us, because it unifies thought and language, music and imagery in a clear, manageable way, most often with play, pleasure, and emotion (Schrott and Jacobs, 2011 ). In this paper, I discuss methods and models for investigating the neuronal and cognitive-affective bases of literary reading together with pertinent results from studies on poetics, text processing, emotion, or neuroaesthetics, and outline current challenges and future perspectives. Observers who note the increasing popularity of bioethics discussions often complain that the social sciences are poorly represented in discussions about things like abortion and stem-cell research. Critics say that bioethicists should be incorporating the methods and findings of social scientists, and should move towards making the discipline more empirically oriented. This way, critics argue, bioethics will remain relevant, and truly reflect the needs of actual people. Such recommendations ignore the diversity of viewpoints in bioethics, however. Bioethics can gain much (...) from the methods and findings from ethnographies and similar research. But it is misleading to suggest that bioethicists are unaware of this potential benefit. Not only that, bioethicists are justified in having doubts about the utility of the social science approach in some cases. This is not because there is some inherent superiority in non-empirical approaches to moral argument. Rather, the doubts concern the nature of the facts that the sciences would provide. Perhaps the larger point is that disagreements about the relationship between facts and normative arguments should be seen as part of the normal inquiry in bioethics, not evidence that reform is needed. Background: Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals. Aim: To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations. Methods: Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group. Ethical considerations: Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research. Result/conclusion: Two categories emerged: one in ‘ethical issues’ (...) and one in ‘emotions and feelings in caring’. The four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness and complexity of (...) practical, concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. Friedrich Hölderlin argued that consciousness requires division and unity. Consciousness emerges through the fundamental distancing of the subject from its surroundings, without which the subject-object distinction would collapse and both objectivity and consciousness would be lost. Nevertheless, insofar as conscious knowledge is unitary, division demands a ground for unity. Hölderlin calls this ground ‘Being [Seyn].’ However, once Being is affirmed, the question of how it is accessed arises. Hölderlin’s scholars disagreed on this issue. This disagreement gave rise to two camps: (...) those who deny that Hölderlin accepts the idea of direct access to Being and believe that he proves Being through an act of reflection (Henrich); and those who argue that for Hölderlin, ‘Being’ is directly accessed. Those who hold the latter position can be further divided into those who conceive of this direct access as knowledge (Frank) and those who argue that this access does not have a cognoscitive character, but rather an aesthetic one (Waibel). This article considers these positions and shows that the direct apprehension of ‘Being’ is part of Hölderlin’s argument aimed at solving a fundamental problem; an argument that differs both from the postulate of access to Being as knowledge of transcendence and from the affirmation of a purely aesthetic mode of access. The distinction between dimensions and units in physics is commonplace. But are dimensions a feature of reality? The most widely-held view is that they are no more than a tool for keeping track of the values of quantities under a change of units. This anti-realist position is supported by an argument from underdetermination: one can assign dimensions to quantities in many different ways, all of which are empirically equivalent. In contrast, I defend a form of dimensional realism, on which some (...) assignments of dimensions to quantities better describe reality than others. The argument I provide is a form of inference to the best explanation. In particular, the technique of dimensional analysis is explanatory, but it is only successful for certain systems of dimensions. Since these dimensional systems support scientific explanations, we have reason to believe that they are real. (shrink)

The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. This paper presents the complete development of the scale, as well as the implications and limitations of the main findings and the managerial implications. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. Business organizations in their work environment, aspire to create a high level of performance and low levels of absenteeism and turnover. Organizational commitment is considered a key factor in achieving this objective, however, it can be conditioned by several factors, among which is the psychological contract. The literature has related the organizational commitment with the fulfillment of the psychological contract framing it as one of the explanatory variables. This work aims to investigate research trends on psychological contract and organizational commitment. (...) For this purpose, bibliometric techniques and the software SciMAT have been used. 220 journal articles indexed in Web of Science (WoS) were analyzed. The findings indicate that the theme chosen for this review is valid. Based on the relationship between the two concepts, as the most recurrent themes, issues such as the sense of justice and the consequences of the violation of the psychological contract, normative commitment, HR management or job insecurity are addressed. However, in the last period analyzed (2015–2018), publications related to more sensitive topics to the present time emerge, such as the employability or the impact of these two concepts in the new generations (millennial and generation-Y) or the retention of talent. On the other hand, shortcomings are detected in the research on the ideologically charged psychological contract, the analysis of the organizational context or cultural and demographic factors in relation to both theoretical constructs. The contribution of this work lies in giving visibility to scientific results, which will serve business organizations as instruments for decision making in their labor management and, for the scientific community, as knowledge of the research spaces to explore. We do not know how much clinical physicians carrying out clinical trials in oncology and haematology struggle with ethical concerns. To our knowledge, no empirical research exists on these questions in a Nordic context. Therefore, this study aims to learn what kinds of ethical challenges physicians in Sweden, Denmark and Finland (n = 29) face when caring for patients in clinical trials; and what strategies, if any, they have developed to deal with them. The main findings were that clinical cancer (...) trials pose ethical challenges related to autonomy issues, unreasonable hope for benefits and the therapeutic misconception. Nevertheless, some physicians expressed that struggling with such challenges was not of great concern. This conveys a culture of hope where health care professionals and patients uphold hope and mutually support belief in clinical trials. This culture being implicit, physicians need opportunities to deliberately reflect over the characteristics that should constitute this culture. (shrink)

Bajo el manto liberal se engloban todas aquellas teorías políticas cuyo objetivo es buscar procedimientos, universalmente compartidos, de agregación de los intereses individuales. Por su parte, en el bando comunitarista, nos encontramos aquellos planteamientos -cuyo denominador común es una crítica a toda visión puramente procedimentalista de la filosofía pública-, que consideran que sólo se posee una comunidad política cuando se recurre a un patrimonio común de contenidos, valores y tradiciones, en el que todos los miembros de la comunidad se sienten radicados. En esta obra se presenta un análisis detallado de los protagonistas y de las etapas de este debate, proponiendo como conclusión un modelo de sociedad que pretende dar respuesta tanto a las instancias radicadas en el modelo procedimental como a las presentes en el modelo comunitario. How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

In “Being Judgement Possibility,” Hölderlin posits that the division between subject and object produced in conscious knowledge requires admitting a being as the ground of that knowledge’s unity. Commentators argue over the way to access such being according to Hölderlin. For Dieter Henrich, being is a presupposition recognized reflexively. Manfred Frank, by contrast, maintains that Hölderlin grants direct access to it in an “intellectual intuition.” This article addresses the respective interpretations of both authors. It shows that Frank’s interpretation is closer (...) to the textual evidence than Henrich’s interpretation. Frank’s interpretation also allows one to explain better the way in which the division between subject and object avoids leading to dispersal. Finally, this article considers the insufficiency of Frank’s interpretation so as to clarify an issue that he himself advances in the course of his argument: how the I manages to distinguish itself in the sphere of intuitable objects. It is now standard to interpret symmetry-related models of physical theories as representing the same state of affairs. Recently, a debate has sprung up around the question when this interpretational move is warranted. In particular, Møller-Nielsen :1253–1264, 2017) has argued that one is only allowed to interpret symmetry-related models as physically equivalent when one has a characterisation of their common content. I disambiguate two versions of this claim. On the first, a perspicuous interpretation is required: an account of the models’ (...) common ontology. On the second, stricter, version of this claim, a perspicuous formalism is required in addition: one whose mathematical structures ‘intrinsically’ represent the physical world, in the sense of Field. Using Dewar’s :485–521, 2019) distinction between internal and external sophistication as a case study, I argue that the second requirement is decisive. This clarifies the conditions under which it is warranted to interpret symmetry-related models as physically equivalent. (shrink)

Normative pragmatics can bridge the differences between dialectical and rhetorical theories in a way that saves the central insights of both. Normative pragmatics calls attention to how the manifest strategic design of a message produces interpretive effects and interactional consequences. Argumentative analysis of messages should begin with the manifest persuasive rationale they communicate. But not all persuasive inducements should be treated as arguments. Arguments express with a special pragmatic force propositions where those propositions stand in particular inferential relations to one (...) another. Normative pragmatics provides a framework within which varieties of propositional inference and pragmatic force may be kept straight. Normative pragmatics conceptualizes argumentative effectiveness in a way that integrates notions of rhetorical strategy and rhetorical situation with dialectical norms and procedures for reasonable deliberation. Strategic effectiveness should be seen in terms of maximizing the chances that claims and arguments will be reasonably evaluated, whether or not they are accepted. Procedural rationality should be seen in terms of adjustment to the demands of concrete circumstances. Two types of adjustment are illustrated: rhetorical strategies for framing the conditions for dialectical deliberation and rhetorical strategies for making do with limitations to dialectical deliberation. In “On what matters: Personal identity as a phenomenological problem” (2020), Steven Crowell engages a number of contemporary interpretations of Husserl’s account of the person and personal identity by noting that they lack a phenomenological elucidation of the self as commitment. In this article, in response to Crowell, I aim to show that such an account of the self as commitment can be drawn from Husserl’s work by looking more closely at his descriptions from the time of Ideas and after (...) of the self as ego or I and egoic experience as attentive experience. I specifically aim to sketch the beginning of a response to three questions I take Crowell to be posing to a Husserlian account of the person and personal identity: (1) What more than pre-reflective self-awareness can be attributed to the self on phenomenological grounds so that we can understand, phenomenologically speaking, how selves become persons? (2) How can what characterizes the self in addition to pre-reflective self-awareness be discerned in both our commitment to truth and our feeling bound by love and other emotive commitments that cannot be fully rationally justified, which Husserl acknowledges are both sources of personal self-constitution? And (3), do all selves become persons? In the paper I elaborate how my answers to the first two questions turn on the self not just being self-aware but active in a particular sense. And to begin to address the third question, I suggest that while any form of wakeful conscious experience is both self-aware and active, this activity of the self makes a difference for those who are socio-historically embedded in the way we are. Specifically, on the proposed Husserlian account, selves that are socio-historically embedded become persons in and through their active relating to what they attentively experience. In concluding, I indicate how this Husserlian account might compare to Crowell’s claim that “self-identity (ipseity) is not mere logical identity (A=A) but a normative achievement […] which makes a ‘personal’ kind of identity possible” (2020). Currently, value sensitive design (VSD) does not commit to a particular ethical theory. Critiques contend that without such an explicit commitment, VSD lacks a methodology for distinguishing genuine moral values from mere stakeholders-preferences and runs the risk of attending to a set of values that is unprincipled or unbounded. We argue that VSD practitioners need to complement it with an ethical theory. We argue in favour of a mid-level ethical theory to fulfil this role.

Physics presents us with a symphony of natural constants: G, h, c, etc. Up to this point, constants have received comparatively little philosophical attention. In this paper I provide an account of dimensionful constants, in particular the gravitational constant. I propose that they represent inter-quantity structure in the form of relations between quantities with different dimensions. I use this account of G to settle a debate over whether mass scalings are symmetries of Newtonian Gravitation. I argue that they are not, (...) but only if we interpret mass anti-quidditistically. This is analogous to anti-haecceitism in the presence of spacetime symmetries. (shrink)

People that over-identify with one group or tribe for ideological reasons invariably meet with disappointment because (...) there will always be some tenets they internally oppose and disagree with. Yet they ignore their inner voice in order to ‘fit in with the rest.’ Man is a social animal and excommunication from the tribe has been tantamount to extinction of our lineage since our days as hunters and gatherers. By living transcendentally I have learned to acknowledge, welcome and accept the space between myself and my tribe. I invite you to do the same. -/- Learning to listen to the God within, I can trust my inner voice more because there is a message spoken there, uniquely for me, that will never be printed on the pages of the Bible, or the Koran, or the Tao Te Ching, or any other book for that matter. There’s only one YOU. Others may have your name, but not your identity. They may share your birth date and hospital, but not your parents. They may share your parents, but not your name. Do you see what I’m getting at here? Therefore how can a ‘one-size fits all’ religion, education or philosophy possibly answer the question to your meaning of life? There is no the meaning of life, because there is no the life. There are infinite lives, for which infinite meanings must be furnished. On September 19th, 2005, an Spanish blogger wrote a post against blog nets. In that post he showed a kierkegaardian interpretation of blogging issue. It was the first time someone was using strictly philosophical categories in the blogosphere. On 2006, February, the 23rd, Rafael Herrera Guillén made a philosophical dramatization about this issue in a game of heteronyms.

The infamous Hole Argument has led philosophers to develop various versions of substantivalism, of which metric essentialism and sophisticated substantivalism are the most popular. In this journal, Trevor Teitel has recently advanced novel arguments against both positions. However, Teitel does not discuss the position of Jeremy Butterfield, which appeals to Lewisian counterpart theory in order to avoid the Hole Argument. In this note I show that the Lewis-Butterfield view is immune to Teitel’s challenges.

This article presents the framework Capability Sensitive Design (CSD), which consists of merging the design methodology Value Sensitive Design (VSD) with Martha Nussbaum's capability theory. CSD aims to normatively assess technology design in general, and technology design for health and wellbeing in particular. Unique to CSD is its ability to account for human diversity and to counter (structural) injustices that manifest in technology design. The basic framework of CSD is demonstrated by applying it to the hypothetical design case of a (...) therapy chatbot for mental health. By applying CSD to a design case, the merits of this new framework over the standard VSD approach become apparent. Also, the application demonstrates what a technology design would look like when attention is paid to capabilities right from the start of the design process. (shrink)

Professional musicians are expected to perform at a very high level of proficiency. Many times, this high standard is associated with perfectionism, which has been shown to prompt both adaptive and maladaptive motivational dynamics and outcomes among music students. The question about how perfectionism interplays with motivational dynamics in music students is still unanswered and research within this line is scarce, especially in Latin America. In the light of Self-Determination Theory, this cross-sectional study investigated the relationship between the perceptions of (...) motivational context, basic psychological needs, perfectionism, and flourishing in University music students from Lima, Peru. We performed a path analysis testing a model in which motivational teaching styles predicted both, perfectionism and flourishing via need satisfaction and frustration. The model's fit indices were ideal [χ2 = 7.48, p = 0.300, CFI = 0.998, TLI = 0.992, RMSEA = 0.021, SRMR =0.040]. In this model, perceived autonomy supportive style predicted need satisfaction positively and need frustration negatively; perceived controlling teaching style did not predict need satisfaction nor frustration. In turn, need satisfaction positively predicted adaptive perfectionism and flourishing; whereas, need frustration predicted maladaptive perfectionism. These results shed light on the relevance of perfectionism in the psychology of higher music education students. Lastly, we highlight the importance of autonomy support in fostering adaptive high standards and flourishing in music learning. (shrink)
